July 22 2004 - 2 months after our water infiltration issues start, Heartland Homes states

May 2005 We send the certified letter to Heartland Homes founder, Heartland Homes owner. Almost 3 weeks later no response to our certified letter that was signed for and received.
June 29 2005 Heartland Homes states; "We met with Mr. Romesburg and discussed solutions for his door and WET BASEMENT
problems. We are currently working with Mr. Romesburg to remedy these issues." |

** When I called Heartland Homes in
April 2005; because we continued to have water issues. What I was told by Michele from Heartland Homes Warranty Dept. I will not post anywhere on our website(s) or any where else.
During the court trial we had December 2008, I was told what I stated was considered hearsay.
Since I do not have it in writing and since Michele was not called to testify, in our opinion that is why it was objected to and considered hearsay.
May 17/19 2005 Before we filed our Heartland Homes Pittsburgh complaint with the Better Business Bureau (BBB), we did send a letter to the founder owner(s) of Heartland Homes. See information below showing our certified letter was signed for and other details.
We asked for a response within 3 weeks before moving forward filing our complaint against Heartland Homes Pittsburgh.
We never received any acknowledgement or response from Heartland Homes. We filed our consumer complaint with the Better Business Bureau in Pittsburgh.
The founder of Heartland Homes Pittsburgh is Alan Gillespie. The President Heartland Homes Pittsburgh is Marty Gillespie.
During our court trial December 2008, Marty Gillespie stated on the
court stand he is the President of Heartland Homes in Pittsburgh.

Please remember we reported our initial water infiltration issues May 2004, 3 months after closing on our brand new Heartland Homes home.

June (mid) 2005 -
Marty Gillespie from Heartland Homes visits our brand new home with Craig to review what is needed to resolve our water issues. I don't recall exactly how Marty Gillespie phrased the work Heartland Homes planned on doing after we filed our complaint with the BBB.
The following are emails I sent to Marty Gillespie of Heartland Homes, shortly after his visit to our Heartland Homes Pittsburgh built home mid/end June 2005.

June 2005 - Marty Gillespie, Heartland Homes Pittsburgh came to our home with Craig F. from Heartland Homes. Marty walked around our home pointing out to Craig what needed to be taken care of. Marty Gillespie, specifically told me, Dave Romesburg that Craig F. was our point person to take care and handle our issues. However Marty Gillespie from Heartland Homes explain it to me, Craig was to initiate and make sure the work was being taken care of regarding our water issues.

since we filed our complaint with the BBB, we find water in our electrical panel after Heartland Homes trenching work is completed. Please remember we reported our initial water infiltration issues May 2004, 3 months after closing on our brand new Heartland Homes home.

3. No one from Heartland Homes ever came to our home to make
recommendations or
suggestions about what
we needed to do as homeowners to correct our water issues.
Marty Gillespie from Heartland Homes did come to our home after we filed our complaint as I mentioned in item #2 above.
Marty Gillespie from Heartland Homes walked around our home with Craig (from Heartland Homes) and myself, Dave Romesburg.
Marty Gillespie from Heartland Homes pointed out to Craig (Heartland Homes) what was to be done at our home, period. (I am assuming this is the reason the work was done after we filed our complaint). |
Please keep in mind our
water issues started 3 months
after our closing on our
brand new 1st owner home and
continued for more than a few years.

4. Heartland Homes never sent a Structural Engineer to our home to investigate our water issues. No Structural Engineer ever came to our Heartland Homes home to discuss what we needed to do to correct our water infiltration issues.
Sorry for repeating this information, I just wanted to clarify this. For those of you who have mentioned this to us via email, please note, no Structural Engineer from Heartland Homes.
Only the Structural Engineer we paid to inspect our home for water issues and be our expert witness during our court trial. |
